Below you will find the answers to the questions we get asked most frequently about electronic I-9s.
When completing the I-9, employees should use their legal name as shown on their documents.
The employee is responsible for completing Section 1. They may use a translator if they do not understand enough English to complete it. However, the translator must complete the Preparer and/or Translator Certification block. The employee must still sign the certification block in Section 1.
Any adult (other than the employee) over the age of 18 and is in the same physical location as the employee. This means that Section 2 can be completed by an HR Coordinator, supervisor, or someone of the employee鈥檚 choosing. Some common choices include friend, family member, colleague, or neighbor as well as members of the community such as a representative from your bank or local education institution.
No. You can provide the employee with the approved documents list. The employee must be allowed to choose which documents to present for Section 2 of the Form I-9. We must not request specific documents or reject acceptable documents because we prefer others.

Employees who fall into one of these categories must provide 3 documents for their I-9: foreign passport, I-94, and the I-20 (F-1) or DS-2019 (J-1). The I-94 or DS-2019 will have the program expiration date, which should be used as the work authorization end date.
In order to complete an I-9 in this situation, the following steps must be taken.
- In the I-9 form, the employee must select An Alien Authorized to Work Until option.
- Employee enters the expiration date from the I-20 or DS-2019.
- Employee enters the I-94 admission number or corresponding foreign passport information, when applicable.
- The employee then selects Foreign Passport, I-94/I-94A, and I-20 or DS-2019 option and uploads copies of all three documents.
- This action will insert I-94/I-94A in the second Document Title and DS-2019 in the third Document Title.
- The remote agent will verify all three documents for the Section 2 of the I-9.
- Select the D/S box next to Expiration Date field within I-94/I-94A area and complete remaining fields for passport document number, expiration date, selecting I-20 or DS-2019 as the third document title, and entering the corresponding document number and expiration date.

Most of the 鈥榦verdue鈥 I-9s aren't truly overdue at the moment; these are mostly the COVID-19 I-9s that need to be redones. Their due date populating in LawLogix is based upon their most recent hire date, which means they are 鈥榦verdue鈥. You can easily identify the COVID-19 I-9s by looking at the Start Date (if it is not recent, then they are a COVID-19 I9). Keep in mind that for all COVID-19 I-9s, the due date is August 30th.
The only employees that are currently required to use the electronic I-9 are those who have COVID-19 I-9s that need to be redone.
